Need to Sign a Waiver or Not?

Up to this point Ive only tattooed a hand full of family and close friends. But now I have friends of friends of friends, etc. asking me to tattoo them. So should I have them sign a waiver or not? Obviosly I dont have a license yet so Im not sure if that would be a good idea or not.

this is a question i am interested in hearing the answer to. also to add to ash13's question if they should sign a waiver/ release form how should it be worded like what should it look like?

I've been thinking alot about this myself. I definately wouldnt mind hearing what someone else has to say. That being said, here's a sample waiver i have from my tattoo bible handbook. hope it helps...

"I acknowledge by signing this document that (insert tattoo artist or shop name) has given me full opportunity to ask all questions I might have regarding obtaining a tattoo. All of my questions have been answered to my complete satisfaction. My signature also acknowledges that i have been specifically advised about the facts and matters set forth below and my agreement to the following:

1. i am not a hemophiliac, nor do i have diabetes, epilepsy, hepatitas, HIV, AIDS, or any other communicable disease.

2. i am not under the influence of alcohol or drugs.

3. i acknowledged that it is not reasonably possible for the representatives and employees of (artist name or shop) to determine whether i might have an allergic reaction to the pigments or process used in my tattoo, and i agree to accept the risk that such a reaction is possible.

4. i acknowledge that infection is always possible as the result of obtaining a tattoo, particularly in the even that i do not take proper care of the tattoo, and i agree to follow all instructions concerning the healing process.

5. i agree that any touch up work due to my own negligence will be done at my own expense.

6. i realize that variations of color and design may exist between that tattoo i have selected and how it is ultimately applied to my body. i understand that my skin tone will affect how bright the colors appear on my skin when compared to someone else.

7. i acknowledge that a tattoo is a permanent change to my appearance and that no representations have been made to me as to the ability to later change or remove my tattoo.

8. to my knowledhe, i do not have any physical, mental, or medical impairment or disability that might affect my well being as a direct or indirect result of my decision to have any tattoo-related work done at this time.

9. i acknowledge that i have truthfully represented to the employees and representatives if (insert tattoo artist/shop name) that i am over the age of 18 years.

10. i acknowledge that obtaining my tattoo is by my choice alone, and i consent to the application of the tattoo and to any action or conduct reasonably necessary to perform the tattoo procedure.

11. i agree to release and forever discharge and hold harmless (insert tatto artist/name of shop) and its employees from any and all claims, damages, and legal actions arising from or connected in any way with my tattoo or the procedures and conduct used to apply my tattoo.

if you don't have license and give them a waiver to sign, to be off any use it will have your name on it.To my mind instead of becoming a waiver it then becomes evidence

As it is technically Illegal to tatoo anywhere other than a licensed shop, a waiver isn't worth the cost of ink to print one!, it would not stand up in court and as previously stated would act as evidence against you.

Whenyou do get registered, it is a 100% must. Its not just to cover you or them it is required by law.
It is basically a consent form, so all you need is name, address and type of tattoo. Mine has a small list of skin conditions etc, but simply add a tick box after them all, saying no i do not suffer from any of the above.
As i said, whether registered or not, its worth doing.

So if someone like me has diabetes and they say they have it,
are you supose to turn them away or do they put on the waiver that they have diabetes and sign it :icon_question:

Can you be sued if a guy is unhappy with his tattoo ?
I don't know the laws in your country, but in mine there are a few things at play:
- legal or not (registered tattooer or not),
- paid or free tattoo (can't complain over a consent for a free tattoo),
- adequation between the reference design and the finished tattoo,
- signed waiver or not (this is an obligation for the client to have a knowledge of what can happen + it covers your ass if the client lied about any of his affections/medical problems)
- injuried skin or not,
- message in the tattoo (tattoing racist/nazi deisgns is illegal in my country. Also scripting down "low motherfucking cocksucking bitch" on someone could cost you, if that wasn't the original design).

And that's all.
